These terms and conditions (hereinafter, the “Terms of Use”) govern access to, browsing and use of the website perspectiva10.com (hereinafter, the “Website”), as well as the liabilities arising from the use of its contents (including texts, graphics, drawings, designs, code, software, photographs, music, videos, sounds, databases, images, expressions and information, and any other creation protected under national and international intellectual and industrial property laws) by any Internet user visiting it (hereinafter, the “User”).

1.2. The Terms of Use also govern the sending (by any means, in particular by post or email) or uploading of texts, drawings, photos and digital videos to Perspectiva 10, S.L., for dissemination through the Websites.

1.3. In compliance with Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), users are hereby informed that the owner of this website is Perspectiva 10, S.L., info@perspectiva10.com, with registered office at Alaquàs (Valencia), Camí del Bovalar 21, P.I. 1.4. By browsing the Website or sending/uploading any text, photograph, video or other content (hereinafter collectively “Materials”), the User fully and unreservedly accepts each and every one of these Terms of Use.

2.1. Perspectiva 10 is the owner or licensee of the intellectual and industrial property rights of the Website and the contents available through it.

2.2. Under no circumstances shall User access to the Website be understood as any waiver, transfer, licence or assignment, in whole or in part, of such rights by Perspectiva 10.

2.3. It is expressly forbidden to remove, circumvent or manipulate copyright notices or any other identifying data of Perspectiva 10’s rights.

2.4. The reproduction, distribution, modification, commercialisation, decompilation, disassembly, reverse engineering or any other technique to obtain the source code of the Website or any of its elements constitutes an infringement of Perspectiva 10’s intellectual property rights.

2.6. Reproduction, plagiarism, distribution or public communication of any of the contents available on the Website without Perspectiva 10’s authorisation constitutes a criminal offence under Section One, Chapter XI, Title XIII of the Spanish Criminal Code (Articles 270 et seq.), which regulates “offences relating to intellectual and industrial property, the market and consumers”. Such offences may be punished by prison sentences of up to four years, fines and civil liability.

3.1. Perspectiva 10 does not guarantee the lawfulness, reliability, usefulness, truthfulness or accuracy of data, programs, information or opinions accessible on the Website.

3.2. Perspectiva 10 does not guarantee: (i) the continuity and accessibility of the Website’s content; (ii) the absence of errors in such content; (iii) the absence of viruses or other harmful components on the Website or on the server providing it; (iv) the invulnerability of the Website; (v) damages caused to itself or third parties by any person infringing the conditions, rules or instructions established by Perspectiva 10 on the Website or breaching its security systems.

Perspectiva 10 assumes no responsibility for any aspect of the website that establishes a link to Perspectiva 10’s Website.

5.1. Perspectiva 10 may modify these terms and conditions at any time and unilaterally.

5.2. Perspectiva 10 may terminate, suspend or interrupt access to the Website’s content at any time without prior notice, without the User being entitled to any compensation.

6.1. The User shall be solely responsible for sending or uploading Materials to the Website and for publishing or disseminating them through the Website. The User warrants that they are the author of the Materials or have the necessary licences and permissions to authorise Perspectiva 10 to publish and disseminate them.

6.2. The User warrants that they have the written consent of all identifiable persons appearing in the Materials for the publication and dissemination of their image and, where appropriate, their name, through the Website.

6.3. The User warrants that the Materials uploaded to the Website do not harm third parties or Perspectiva 10. In particular, the User warrants that the Materials do not include images, sounds or texts that are illegal, morally reprehensible, defamatory, threatening, pornographic or racist; and that they do not infringe image rights, intellectual or industrial property rights, or violate the honour or dignity of any person.

6.4. By sending or uploading Materials to the Website, the User automatically grants Perspectiva 10 a free, non-exclusive, sub-licensable, worldwide licence for the maximum term provided in Article 26 of the Spanish Intellectual Property Law to use, reproduce, distribute, transform, publicly communicate and make available the Materials. This licence authorises Perspectiva 10 to distribute and disseminate the Materials by any means, particularly over the Internet. Perspectiva 10 is under no obligation to publish or disseminate the Materials and will decide freely if, when and for how long they are published.

6.5. Perspectiva 10 declines any liability arising from the publication or dissemination of the User’s Materials. Perspectiva 10 will remove any Material that infringes intellectual or industrial property rights, image rights, honour, privacy or any other legal provision, upon proper notification of such infringement. The User shall be liable to third parties and to Perspectiva 10 for any judicial or extrajudicial claim related to the Materials, their publication or dissemination.

7.1. The headings of the different clauses are for information purposes only and shall not affect, qualify or extend the interpretation of the Terms of Use.

7.2. If any provision of these Terms of Use is declared null or unenforceable, in whole or in part, by any competent court or administrative body, such nullity or un-enforceability shall not affect the remaining provisions.

7.3. The failure of Perspectiva 10 to exercise or enforce any right or provision contained in these Terms of Use shall not constitute a waiver thereof, unless acknowledged and agreed in writing.

8.1. These Terms of Use are governed by current Spanish law.

8.2. The parties expressly submit, waiving any other jurisdiction, to the Courts and Tribunals of Valencia for any interpretation or dispute arising from these Terms of Use.
